What to Know About Child Custody in Florida

Florida law uses the terms “parental responsibility” and “time-sharing” when referring to what is commonly known as “child custody.”

Below are further details:

  • Parental responsibility determines who has the authority to make major decisions about a child’s upbringing, such as those concerning the child’s education and healthcare.
  • Time-sharing refers to the actual schedule that dictates when a child spends time with each parent. This can range from equal time-sharing to arrangements where one parent has most overnights.

Florida courts typically favor shared parental responsibility, unless one parent is found unfit or circumstances make joint decision-making impractical. No matter the case, courts aim to serve the best interests of a child when establishing parental responsibility. The same applies to time-sharing. Courts encourage arrangements that foster meaningful relationships between parents and their children.

Who Pays Child Support?

Florida considers various factors when determining who should pay child support and how much, including:

  • Each parent’s income and assets
  • The child’s needs
  • Who the child spends the most/least time with (i.e., who has the greater or lesser time-sharing responsibility)
  • The cost of health insurance and other crucial expenses
