How Family Law Mediation Works in Florida

Mediation can begin voluntarily or by court order. Under Florida Family Law Rules of Procedure Rule 12.740, a Miami-Dade family court judge may refer contested issues to mediation before scheduling a final hearing. Once mediation begins, Florida courts generally require it to conclude within 75 days of the first conference.

Sessions are conducted by a Florida Supreme Court certified mediator who remains neutral throughout. Each party may have their attorney present and can meet separately with the mediator in private sessions called caucuses, where each side can speak candidly about their priorities without the other party in the room. Statements made during mediation are confidential and generally can’t be used as evidence if the case proceeds to litigation.

When the parties reach an agreement, it’s put in writing, signed, and submitted to the judge for approval. Once incorporated into a final judgment, it carries the full force of a court order. If no agreement is reached, the case moves to litigation, and a judge decides the contested issues.

Mediation vs. Litigation for High-Net-Worth Family Law Disputes

If mediation doesn’t produce a full agreement, the parties can continue through the litigation process.
