How Florida Courts Determine Child Support

In Florida, child support is governed by guidelines in Florida Statute §61.30. These guidelines use a mathematical formula that considers several factors, including:

  • Each parent’s gross monthly income
  • The number of children needing support
  • The amount of time each parent spends with the child (time-sharing)
  • Childcare and healthcare costs, including insurance premiums
  • Extraordinary expenses, such as medical needs or private schooling

The court calculates a presumptive child support amount based on the above. However, judges can deviate from the guidelines to account for a child’s particular needs or a parent’s ability to pay. Even in shared custody and time-sharing situations, one parent may still be required to pay support if their income is significantly higher.

How Long Will You Need to Pay Child Support?

  • If the child has a physical or mental disability that prevents self-support, payments may be indefinite.
