How Federal Law Changes Florida Divorce Proceedings

Florida divorce law applies to military couples in the same foundational ways it applies to everyone: residency requirements, equitable distribution of marital assets, and a court process governed by state statute. Two federal statutes, however, create rules that override or modify the state framework in specific circumstances.

The SCRA protects active-duty service members from default judgments and allows them to request a stay of proceedings when military service materially affects their ability to participate. A service member who can’t meaningfully participate due to active duty can invoke these protections to avoid being declared in default. The stay isn’t indefinite, but it prevents the court from moving forward without the service member’s meaningful participation.

Florida also relaxes its standard six-month residency requirement for military filers. A service member stationed in Florida may file for divorce here even without six months of in-state residence. If neither spouse satisfies Florida’s residency rules, divorce may be filed in the state where one spouse holds legal domicile or has previously resided.

Military Retirement Pay & the USFSPA

The USFSPA, enacted by Congress in 1982, authorizes state courts to treat military retirement pay as marital property subject to equitable distribution. Florida courts can award a portion of retirement benefits to the non-military spouse, but the division must be specifically ordered by the court and incorporated into the final decree. There’s no automatic entitlement; it has to be litigated or negotiated and clearly documented.

Two thresholds govern how that division is administered after divorce:

• The 10/10 rule: To qualify for direct payment from the Defense Finance and Accounting Service (DFAS), the marriage must have overlapped with at least 10 years of creditable military service. Below that threshold, a court can still award a share of retirement benefits, but the service member pays the former spouse directly rather than through DFAS.
• The 20/20/20 rule: A former spouse married to the service member for at least 20 years, with at least 20 years of creditable military service and a 20-year overlap between the marriage and service, may retain TRICARE healthcare coverage and commissary and exchange privileges after the divorce is final.

Retirement pay calculations can also involve disability pay and concurrent retirement and disability pay (CRDP), a benefit that allows eligible retirees to receive both retirement pay and disability compensation simultaneously. Courts treat these components differently, and the distinctions carry real financial consequences for both parties.

Child Custody & Deployment in Miami Military Divorce Cases

Florida courts apply the best interests of the child standard to all custody decisions, weighing factors such as each parent’s stability, their ability to support the child’s relationship with the other parent, and any special needs of the child. For military families, deployment introduces a layer that civilian custody proceedings don’t face.

Florida law generally protects a deployed parent’s custody rights during active service. Deployment alone isn’t grounds for a permanent custody modification. Courts may approve temporary parenting plan changes to ensure the child is cared for during a deployment, but they’re cautious about making permanent changes while a parent is on active duty and unavailable to fully participate in the proceedings.

Long-distance parenting plans for military families often include provisions for electronic communication during deployment, make-up time when the service member returns, and clear protocols if the non-deployed parent needs to relocate. A parent seeking to permanently modify custody while the other is deployed faces a high bar: courts generally require a showing that the change protects the child’s welfare, not that it’s simply more convenient for the parent who stayed behind.

Support Calculations When Military Income Is Involved

Florida child support and alimony are calculated based on each party’s income, and for an active-duty service member, that picture includes more than base pay. Basic Allowance for Housing (BAH), Basic Allowance for Subsistence (BAS), and other regular entitlements are factored in. For a reservist who moves between active and reserve status, income can shift significantly, and support orders may need to account for that variability.

Federal law also caps the portion of a service member’s disposable retired pay that can be allocated to satisfy support obligations. Courts must work within those federal limits when setting amounts, which makes accurate income analysis important from the start rather than something to correct later.

A military spouse who stepped back from career advancement to support a service member’s career may have grounds for alimony, particularly bridge-the-gap or durational support while reestablishing financial independence. When a service member retires or separates and loses certain allowances, existing support orders may need to be modified to reflect the changed income. These aren’t automatic adjustments; they require a return to court with proper documentation.
